CONTENTS OF THE ARRANGEMENT
The organizer of the trip guarantees the realization of the arrangement according to the description in the program. The content of the arrangement will be fulfilled in full and in the described manner, except in case of influence of "force majeure", which could not be foreseen (war, terrorist actions, strike, natural disasters, traffic and technical problems in transportation, or similar).
APPLICATION - AGREEMENT AND PAYMENT
Application-agreement for travel is made until the places are filled, with advance payment of the price specified for each individual program. Applications can be made at the MangoTravel point of sale and at all other agencies authorized to sell its programs. When registering, the buyer pays an advance of 30% of the value of the arrangement, and the rest after confirming the reservation from the reservation service, and that no later than 15 days before the realization of the arrangement. If the passenger does not make an additional payment for the arrangement by that deadline, the organizer will consider that the passenger is canceling the arrangement and will charge the cancellation fees for the arrangement in accordance with the terms of Article 6 "Cancellation of the trip" by the passenger. When checking in, the traveler signs an application-agreement with a statement - I declare that I am familiar with the program and the General Conditions of Travel, and that I fully accept them! thus the General conditions of travel become a legal obligation for the organizer and the passenger.
PRICE OF THE ARRANGEMENT
The prices for all trips are published in Denars or in Euros with an obligation to pay in Denar equivalent according to the exchange rate on the foreign exchange market - published by the organizer. Any request for additional services implies additional payments. The organizer reserves the right to change the price of the arrangement in case of a change in the prices of hotel, transportation and other services, as well as in case of a change in the exchange rates on the market. A price increase of up to 10% does not require the buyer's consent (it is calculated on the rest of the payment). In the event of an increase of more than 10%, the buyer has the right to terminate the contract without the obligation to compensate for the damage resulting from the termination. If the traveler does not notify the travel organizer in writing within the specified period that he is canceling the contract, he is considered to have accepted the new price. Additional announcement of travel price reductions (for example, "last minute" type discounts) cannot refer to already concluded contracts and cannot be the basis for any objection or complaint of the traveler to the travel organizer.
CATEGORIZATION AND DESCRIPTION OF SERVICES
The offered hotels and apartments are described according to the official categorization at the time of the publication of the catalog. The quality of services is standardized by local tourism authorities. Accommodation and service standards vary by destination and are not comparable. The organizer does not take responsibility for any other oral or written information, which is not in accordance with the description of the services in the offered program. If the traveler has not agreed in writing on certain services, with additional characteristics and quality, there is no basis for submitting an objection to the travel organizer.
ORGANIZERS RIGHT TO CHANGES IN THE PROGRAM AND CANCELLATION OF THE ARRANGEMENT
The organizer has the right to modify the program (in duration or content) in case of force majeure or extraordinary circumstances that he could not foresee, avoid or eliminate. The travel participant has the right to a refund of the amount for the unrealized services. In rare cases when there is no possibility of accommodation in the reserved facility, due to technical reasons or "over booking" by the hotelier, the organizer will accommodate the traveler according to the possibilities at the given moment, in a facility of the same category or of a higher category, without compensation. The organizer reserves the right to postpone or cancel the arrangement in case of an insufficient number of registered passengers from the stipulated minimum for a certain arrangement. The organizer is obliged to notify all buyers of the cancellation at least 5 days before the start of the implementation of the arrangement and to return the funds paid in full within 8 days from the day of cancellation at the latest.
RIGHT OF THE PASSENGER TO CANCEL THE TRIP
The passenger can cancel the trip at any time and should do so in writing. The date of the written cancellation is the basis for the calculation and collection of the cancellation costs (in relation to the basic price of the arrangement), according to the following scale: - for cancellation up to 30 days before the trip, 5% is charged - for cancellation from 29 to 22 days before the trip 10% - for cancellation from 21 to 15 days before the trip 20% - for cancellation from 14 to 08 days before the trip 50% - for cancellation from 07 to 01 days before the trip 90% - if the traveler does not show up or cancels the arrangement on the day of its implementation, the organizer will charge the entire amount of the arrangement, i.e. 100%. In case of cancellation of an already confirmed "reservation on request", the organizer will charge cancellation costs in the amount of the advance payment. If the passenger changes the departure date of the same arrangement at least 15 days before the day of the previously confirmed departure, if possible, the organizer will make a change to the reservation and will only charge manipulation costs in the amount of 10 € / Euro, according to the application-contract. If the passenger cancels the arrangement before the start of the trip, due to reasons that he could not foresee, avoid or remove (illness, injury or death in the immediate family, natural disaster or similar), and based on a valid certificate from the competent authorities, in that case, it does not pay the cancellation costs according to the specified scale, but only the costs resulting from the cancellation of the arrangement, which the organizer is obliged to pay without the right to refund. If the traveler wants to be additionally insured against the aforementioned - unpredictable reasons for cancellation of the arrangement, occurring in the period from the signing of the travel contract to the beginning of the trip, we recommend that he insure himself against the "risk of cancellation of an agreed tourist trip" with an insurance company. This insurance policy can be arranged and paid for at the point of sale, simultaneously with the actual payment of the arrangement. If the passenger cancels the arrangement after the start of the trip (during the trip or during the stay in the place of travel), due to events resulting from the influence of "force majeure" (military events, acts of terrorism, natural disasters, traffic accidents) or similar), which neither the traveler nor the organizer could foresee, avoid or eliminate, the organizer is not responsible nor has an obligation to refund funds for unrealized services, unless the final service provider accepts and refunds them.
OBLIGATIONS AND RIGHTS OF THE TRAVEL ORGANIZER
The organizer is obliged to take care of the realization of the services and the selection of the executors of the services with the attention of a good organizer, and to take care of the interests of the travelers in accordance with the professional principles in tourism. The organizer is obliged to provide the traveler with all the services specified for the individual arrangement in the program, and is responsible for any non-performance of the services or part of the services. The organizer excludes any responsibility in case of changes and non-execution of services caused by force majeure as well as delay of means of transport, for which the carrier is not responsible according to positive regulations and international conventions. The organizer of the trip does not accept any responsibility if the diplomatic-consular mission refuses to issue an entry visa or is late in issuing the visa, or if the immigration department of a foreign country does not approve the entry of a particular traveler, nor for any other consequences arising from the possible malfunction or loss of the passengers travel documents. In these cases, the passenger alone pays the additional costs.
OBLIGATIONS AND RIGHTS OF THE PASSENGER
The traveler is obliged to ensure that he personally, his documents and belongings meet the conditions stipulated by the border, customs, health and other regulations of his country as well as the country to which he is traveling, to comply with the house rules in catering and hotel facilities, as well as in means of transportation, and to cooperate with the organizer's representative/companion and the executors of the services in good faith. In case of non-compliance with these obligations, the passenger is liable to the organizer for the damage caused. Passengers who disturb the order in the facilities or the vehicle can be removed from the arrangement. The traveler is obliged to have a valid passport and to inform the organizer if a visa is required for the country he is traveling to (or for the countries through which he is traveling in transit), so that it can be secured in time. The traveler is obliged to inform himself about the foreign exchange and customs regulations in his country and the countries to which he travels. The passenger is obliged to keep and personally answer for all his documents, money and personal luggage for the entire duration of the trip.
TRANSPORTATION BY AIRPLANE
The transportation of passengers by plane is regulated by the international rules of air traffic as well as the rules of the airline company hired by the travel organizer. For all air travel on regular lines, the transportation of passengers in economy class is understood. In case of a change of the scheduled departure time by the airline, as well as a delay of the plane (on one or more regular lines or charter flights during the trip), the travel organizer does not bear the responsibility for possible consequences caused by the delay, rather, the applicable regulations and regulations in the field of air traffic are applied. The discrepancy between the personal data provided to the travel organizer and the data from the passenger's passport (such as providing abbreviated and incomplete names by the passenger) often results in the issuance of new plane tickets, with the costs charged to the passenger or the declaration of the card is irregular, during the journey, with serious consequences for the passengers. The passenger is responsible for his plane ticket from the moment he receives it from the airport guide or agency official at the airport. There is no possibility of issuing a duplicate ticket, nor a boarding pass. The passenger fully bears the consequences of their loss or loss during the trip.
BUS TRANSPORTATION AND BUS TRANSFERS
Transportation by bus and bus transfers are carried out by standard tourist buses according to the regulations and criteria that apply in the countries in which the bus carrier that hires the travel organizer is registered. As a rule, there is no advance seating arrangement for passengers, nor is there a fixed way of changing seats by day during the bus journey. An exception can be individual bus trips; and in such cases this trip is regulated by a special provision in the trip program itself. In the event of a bus delay due to weather conditions, extraordinary traffic conditions, excessive restrictions at the borders, damage to the same, or the like, the travel organizer is not responsible for any delays that may occur. The provisions regarding the journeys by ship or railway are specified in the travel programs in which the use of these means of transport is envisaged.}
LUGGAGE
The passenger has the right to free baggage transportation, up to 15 kg on charter flights and 20 kg on regular airline lines. With bus charter transportation, free luggage of one travel bag (up to 20 kg) per passenger is allowed. For each kilogram of luggage, i.e. a travel bag exceeding the allowance, is paid depending on the travel destination. Children up to 2 years of age on air transport and children who do not pay a ticket on the bus have the right to free baggage according to international rules. As baggage, it is not allowed to bring commercial goods, food, drinks, medicines, narcotics, chemical and other flammable substances, weapons, animals, plants, packaging and similar items. When entering and exiting the luggage from the vehicle, the passenger with personal presence is responsible for it. During the implementation of the arrangement, the passenger takes care of the luggage. Therefore, we recommend that before the trip, a Travel Insurance policy with luggage insurance is taken out through an Insurance Company, which can be paid at the agency. The organizer is not responsible for destroyed or lost luggage, as well as for lost luggage or valuables during the stay at the hotel (we recommend renting a safe at the hotel reception).
HEALTH REGULATIONS AND PROTECTION
The traveler is obliged to inform himself at the competent health institution and to comply with the health regulations for traveling to a certain country (need for vaccine or health document). In case of illness or accident during the use of the arrangement, the costs of treatment or possible medical interventions are paid by the passenger. Therefore, we recommend that, before the trip, a Travel Insurance policy is made through an Insurance Company, which can be paid at the agency.
ACCOMMODATION IN ROOMS AND APARTMENTS
If the traveler-renter has not arranged a room/apartment with special characteristics, he will accept any officially registered room/apartment for accommodation in the agreed facility, described in the catalog and price list. If possible, the organizer will try to respond to the additional requests of the traveler (comfort, orientation of the room, floor, etc.), but cannot guarantee the fulfillment of such a request. The usual accommodation in the rooms is from 2:00 p.m., and leaving the rooms is until 10:00 a.m. (unless otherwise indicated in the house rules).
INDIVIDUAL TRAVEL
For individual "reservations and arrangements" the passenger pays a deposit in the name of reservation costs. If the reservation is accepted by the passenger, the deposit is calculated in the price of the trip. If the travel organizer does not confirm the reservation, the deposit is fully returned to the traveler. If the traveler does not accept the offered or confirmed reservation, the organizer keeps the deposit amount in full. The provisions of point 6 of the General Travel Conditions do not apply to individual reservations and arrangements.
RESOLUTION OF COMPLAINTS
In case of incomplete or poor performance of the services, the passenger has the right to appropriate compensation, only if he submits a written objection to the organizer. Every passenger - holder (signatory) of the contract has the right to object on the basis of an unperformed contracted service. The organizer will not accept in the procedure group objections submitted by several contract holders based on one objection. Objection submission procedure: - Immediately on the spot, the passenger reports the inadequate service to the representative of the organizer, and if he is not there, to the provider of the services. The passenger is obliged to cooperate with the representative and the service provider in good faith in order to remove the reasons for the objection. If the traveler on the spot does not accept the offered solution to the complaint that corresponds to the paid service, the organizer will not respect the additional complaint of the traveler and will not respond to it. - If the reason for the complaint is not removed, the passenger draws up a written confirmation (minute) with the representative. - No later than 8 days after the end of the arrangement, the traveler submits a written objection in the point of sale where he paid for the arrangement, and attaches the written confirmation (minute) signed by the representative as well as any bills for additional costs. The organizer will accept in the procedure only fully documented objections submitted within the specified period of 8 days. - The organizer is obliged to make a written decision within 14 days of receiving the objection at the point of sale. The organizer can postpone the deadline for the resolution of the objection for the purpose of completing the information and checking the specified complaints with the service provider. The organizer will resolve only those complaints for which the reasons that caused them could not be removed in the place of rest. - Until the organizer makes a decision after the objection, the passenger renounces mediation of any other person, court proceedings or providing information in the public media. The possible non-compliance of the buyer-passenger with the same, or violation of the initiated procedure with any activity mentioned or not, gives reason for not accepting the same objections, terminating the initiated procedure and also filing a lawsuit before the competent authorities by the organizer for collection of the damage suffered and the damaged reputation in the public. - The highest compensation after the objection can reach an amount up to the amount of the advertised part of the services, but it cannot include the already used services as well as the total amount of the arrangement. This excludes the buyers right to collect "ideal damage".
JURISDICTION OF THE COURT
In accordance with point 13 of these conditions, the buyer of the services from a specific program has the right to complain to the travel organizer. If the buyer is not satisfied with the decision of the organizer, he has the right to request additional arbitration and opinion by the Court of Honor at SKTM or by the competent Court in Skopje.
